Capital Adequacy Guidelines: Treatment of Perpetual Preferred Stock Issued to the U.S. Treasury Under the Emergency Economic Stabilization Act of 2008
The Board is adopting a final rule to allow BHCs that have issued senior perpetual preferred stock to the U.S. Department of the Treasury to include such capital instruments in Tier 1 capital for purposes of the Board's risk-based and leverage capital guidelines. The final rule will become effective on July 1, 2009. (June 29, 2009)

Capital Adequacy Guidelines
The Board announced the adoption of an interim final rule that will allow S-Corp and mutual BHCs to include in Tier 1 capital all subordinated debt issued to Treasury, with certain other restrictions. The interim final rule also will allow small S-Corp and mutual BHCs to exclude subordinated debt issued to Treasury from "debt" for purposes of the Board's Small Bank Holding Company Policy Statement.
